Photography Services Agreement
This Photography Services Agreement ("Agreement") sets out the terms on which Zubair Malik Photography ("the Photographer", "we", "us") provides photography services to the client named in the accompanying Quote or Invoice ("the Client", "you"). This Agreement applies to all bookings unless expressly varied in writing by the Photographer.

The specific details of each booking - including the shoot date, time, location, type of shoot, agreed price, and deliverables - are set out in the Quote or Invoice issued to the Client for that booking. That Quote/Invoice forms part of, and is incorporated into, this Agreement.
Where this Agreement is made available via a link on an Invoice, payment of that Invoice (in full or in part, including payment of a deposit or booking fee) constitutes the Client's acceptance of this Agreement as it stands at the date of payment. The Photographer will keep a dated, version-controlled copy of this Agreement, and will provide a copy on request.
2. Services
The Photographer will provide photography services as described in the relevant Quote/Invoice, which may include (but is not limited to) wedding, corporate, travel, trade shows, product, fashion, lifestyle, sports, modeling, event, maternity, and portrait photography. The scope, duration, location(s), and any additional personnel (e.g. second shooters) for a given booking will be as stated in that Quote/Invoice.
3. Payment Terms
3.1 Booking Fee
A non-refundable booking fee is payable to confirm and secure the Client's date, and is non-refundable under all circumstances, including where the booking is cancelled or rescheduled by the Client (see clause 4):
Small shoots (30 minutes to 2 hours): a flat booking fee of $200 AUD.
Weddings and other large events: a booking fee of 50% of the total project amount.
3.2 Deposit & Balance
Standard shoots: the booking fee (clause 3.1) acts as the deposit, with the remaining balance due on the day of the shoot.
Bookings made within 3 business days of the shoot date: 100% of the total fee is payable in advance.
Commercial bookings involving a studio, set, models, and/or makeup/styling: 100% of the total fee is payable in advance.
Commercial bookings (as above) where full advance payment does not apply for any agreed reason: the balance is due on release of the final gallery, and the gallery will not be released until the balance is paid in full.
3.3 Accepted Payment Methods
Bank transfer, PayID, and PayPal. Where payment is made via PayPal, any transaction fee incurred may be added to the invoice total.
3.4 Travel
0–20km round trip from the Photographer's base: no charge.
20–50km round trip: $50 travel fee.
50–100km round trip: $100 travel fee.
100km+ round trip or more: applicable travel fee above, plus a $300 per day distance surcharge.
3.5 Parking
A standard parking allowance of up to $10 is included in the package price. For shoots in CBD areas or at prime locations like beach, resorts, actual parking costs will be charged in addition to the package price and itemized on the final invoice.
3.6 Rush Fee
Bookings confirmed within 48–72 hours of the requested shoot date will incur a rush fee of 30% of the total invoice.
3.7 Sunday Surcharge
Shoots scheduled on a Sunday will be charged at double (2x) the standard rate.
3.8 Overtime
Where a shoot runs beyond the time contracted in the Quote/Invoice, an overtime charge of $200 per additional hour (or part thereof) applies.
3.9 Urgent Delivery
Standard delivery timeframes are set out in the relevant Quote/Invoice. Where the Client requires final delivery within 48 hours of the shoot, an urgent delivery fee of $200 per hour of contracted shoot length applies (for example, a 2-hour shoot with urgent delivery incurs a $400 fee).
3.10 Late Payment
If any amount is not paid by its due date, the Photographer reserves the right to withhold delivery of images/files until payment is received in full, in addition to any other remedy available at law.
4. Cancellation & Rescheduling
4.1 Cancellation by the Client
The booking fee (clause 3.1 - $200 for small shoots e.g under 30mins-2 hours, and $500 for weddings/large events) is non-refundable in any case of cancellation or rescheduling by the Client, regardless of notice given.
7 or more business days' notice: no further amount is forfeited beyond the booking fee.
Less than 7 business days' but more than 48 hours' notice: $500 is forfeited, in addition to the booking fee.
Less than 48 hours' notice: $1000 is forfeited, in addition to the booking fee.
Rescheduling is treated the same as cancellation for the purposes of notice periods and fees, unless the Photographer agrees otherwise in writing, and is always subject to the Photographer's availability on the new date.
4.2 Cancellation or Non-Attendance by the Photographer
If the Photographer is unable to attend a confirmed shoot due to illness, emergency, or other unavoidable circumstance, the Photographer will make reasonable efforts to arrange a suitably qualified backup photographer. If no backup is available and the shoot cannot proceed, the Client will receive a full refund of all amounts paid for that booking, including the booking fee.
4.3 Weather & Force Majeure
For outdoor shoots, in the event of severe weather or conditions that make the shoot unsafe or impractical, the Photographer and Client will agree to reschedule at no additional charge. Neither party is liable for delay or failure to perform this Agreement due to circumstances beyond their reasonable control (including extreme weather, natural disaster, illness, or government restrictions).
5. Copyright & Usage Rights
5.1 Ownership
The Photographer retains copyright and all intellectual property rights in all images and other materials created under this Agreement, in accordance with standard photography industry practice and the Copyright Act 1968.
5.2 Client Licence
On payment in full, the Client receives a non-exclusive, non-transferable license to use the delivered images for personal use, including printing, sharing, and posting on personal social media. Commercial use (including advertising, resale, or use by a business) requires separate written agreement and may incur an additional licensing fee.
5.3 Editing
The Client must not alter, edit, crop, apply filters to, or otherwise modify delivered images, or remove any watermark or attribution, without the Photographer's prior written consent.
5.4 Photographer's Use
The Photographer retains the right to use any images from the shoot for portfolio, marketing, competition entry, and promotional purposes (including on the Photographer's website and social media), unless the Client opts out in writing. Where the Client opts out, an opt-out fee of $100 applies.
6. Delivery
The number of edited images to be delivered is as stated in the Quote/Invoice for the relevant booking.
Standard turnaround time will be confirmed in the Quote/Invoice for each booking.
Images are delivered via Google Drive unless otherwise agreed; prints or physical media (e.g. USB) may be arranged at additional cost.
Final images are delivered as high-resolution JPEG files unless another format is agreed in writing.
Unedited RAW files are not included in any package and will only be provided, if at all, by separate written agreement and additional fee.
7. Model Releases
Where a shoot takes place in a public place or involves members of the public, other than the Client, appearing in images, the Photographer will use reasonable efforts to obtain model releases where practicable and required. The Client is responsible for obtaining model releases from any individuals they have engaged to appear in the shoot (e.g. models, talent, staff) unless otherwise agreed in writing. Where property releases are required for a private location, the Client is responsible for obtaining the necessary permission from the property owner.
8. Liability & Insurance
The Photographer holds public liability insurance. To the maximum extent permitted by law, the Photographer's total liability arising from this Agreement is limited to the total fees paid by the Client for the relevant booking. The Photographer is not liable for indirect or consequential loss, or for loss or damage arising from circumstances beyond their reasonable control (including equipment failure, provided reasonable backup procedures were followed).
The Client agrees to indemnify the Photographer against any claim, loss, or damage arising from the Client's breach of this Agreement, or from information, access, or instructions provided by the Client.
9. Client Responsibilities
Providing accurate shoot details (date, time, location, contacts) in advance.
Arranging any venue access, permits, or approvals required for the shoot location.
Nominating a point of contact who will be available on the day of the shoot.
Advising the Photographer in advance of any known hazards, restrictions, or special requirements at the shoot location.
The Client is responsible for the security of the shoot venue or location. In the event of theft or loss of the Photographer's equipment arising from inadequate venue security, unauthorized access, or a hazard at a venue arranged by the Client, the Client shall reimburse the Photographer for the cost of repairing or replacing the affected equipment. This clause does not apply where the loss or theft results from the Photographer's own negligence in handling or securing their equipment.
If the Photographer's equipment is damaged, or shoot content is lost, due to a hazard at the venue that the Client failed to disclose in advance (including but not limited to lasers, pyrotechnics, strobing effects, or other equipment-damaging conditions), the Client is responsible for the resulting loss of event content and shall reimburse the Photographer for the cost of repairing or replacing the affected equipment.
10. Dispute Resolution
This Agreement is governed by the laws of Victoria, Australia. In the event of a dispute, both parties agree to first attempt to resolve the matter in good faith through direct discussion. If the dispute cannot be resolved within a reasonable time, either party may refer the matter to mediation before pursuing formal legal action, and both parties submit to the jurisdiction of the courts of Victoria, Australia.
11. Acceptance
By paying the booking fee, deposit, or any invoice issued in connection with a booking, whether that invoice is paid in person, online, or via a link to this Agreement - the Client confirms they have read, understood, and agree to be bound by the terms of this Agreement.
