This Trade for Print Collaboration Agreement ("Agreement") sets out the terms on which Zubair Malik Photography ("the Photographer", "we", "us") and the model/collaborator named in the accompanying shoot confirmation ("the Collaborator", "you") agree to work together on a Trade for Print (TFP) basis, where no fee is charged or paid by either party. This Agreement applies to the specific shoot referenced in that confirmation unless expressly varied in writing by the Photographer.

The specific details of this shoot, including date, time, location, concept, and expected deliverables, are as agreed in writing between the parties prior to the shoot (whether by email, message, or booking form). That confirmation forms part of, and is incorporated into, this Agreement.
By confirming attendance at the shoot and taking part in it, the Collaborator confirms they have read, understood, and agree to be bound by the terms of this Agreement, including the review and testimonial obligations set out in clause 5.
2. Nature of the Collaboration (No Payment)
This is a collaborative, no-fee arrangement. No payment is made by the Collaborator to the Photographer, and no payment is made by the Photographer to the Collaborator, for the shoot, the time involved, or the images produced.
In place of a fee, each party contributes value to the collaboration:
The Photographer contributes their time, skill, equipment, and post-production work, and provides the Collaborator with a set of final edited images for personal use
The Collaborator contributes their time, likeness, and cooperation during the shoot, and, as set out in clause 5, a Google review and video testimonial that the Photographer relies on for marketing.
Because this is a trade rather than a paid booking, none of the booking fee, deposit, travel surcharge, rush fee, overtime, or cancellation-payment clauses used in the Photographer's standard paid Photography Services Agreement apply to this shoot. Cancellation is instead addressed in clause 9 below.
3. Scope of Shoot
The shoot date, time, location, concept, and any wardrobe, styling, or location requirements are as agreed in writing between the parties before the shoot. Any changes to scope on the day (extra locations, extra looks, extended time) should be agreed by both parties before proceeding.
4. Deliverables
The Photographer will deliver final edited, high-resolution images from the shoot, in JPEG format, via Google Drive, within 5-7 business days of the conditions in clause 5 being met.
Unedited RAW files are not included and will not be provided at all.
5. Google Review & Video Testimonial (Consideration for TFP)
As this is a free collaboration and not a paid booking, the Collaborator's agreement to provide the following is treated as the consideration for the Photographer's time and services, and is a condition of this Agreement
A 5-star Google review of Zubair Malik Photography, including at least one photo from the shoot, posted to the Photographer's Google Business listing.
A short video testimonial (approximately 30-60 seconds) in the Collaborator's own words, describing their experience working with the Photographer, for the Photographer's use in marketing and promotional material.
The Photographer will provide a small number of preview/sneak-peek images to assist the Collaborator in writing the review and recording the testimonial. Final edited images (clause 4) will be delivered once the review and testimonial have been received and confirmed by the Photographer.
The Collaborator grants the Photographer a non-exclusive, perpetual right to use the review and video testimonial (including the Collaborator's name, voice, and likeness as they appear in it) on the Photographer's website, social media, and other marketing material, without further compensation.
If the Collaborator does not wish to leave a public review or record a testimonial, this Agreement does not apply and the shoot should instead be booked as a standard paid shoot under the Photographer's usual Photography Services Agreement.
6. Copyright & Usage Rights
6.1 Ownership. The Photographer retains copyright and all intellectual property rights in all images created under this Agreement, in accordance with standard photography industry practice and the Copyright Act 1968.
6.2 Collaborator Licence. The Collaborator receives a non-exclusive, non-transferable licence to use the delivered images for personal, non-commercial use, including printing, sharing, and posting on personal social media, with credit to the Photographer (clause 8). Commercial use (including use in advertising, by a business, or for paid promotion) requires separate written agreement.
6.3 Photographer's Use. Because this shoot is undertaken specifically to build the Photographer's portfolio and marketing material, the Photographer retains an unrestricted right to use any images from the shoot for portfolio, website, social media, marketing, competition entry, and submission to publications. Unlike the Photographer's standard paid agreement, no opt-out is available for TFP shoots, as portfolio and marketing use is the basis on which the shoot is offered at no charge.
7. Model Release
The Collaborator grants the Photographer a full release to use their image, likeness, and voice (as captured in the shoot and any testimonial) in the Photographer's portfolio, website, social media, marketing material, competition entries, and submissions to publications, without further compensation or approval required for each use.
8. Credit & Editing
Where the Collaborator posts or shares delivered images publicly, they agree to credit the Photographer by tagging "Zubair Malik Photography" and/or including the Photographer's handle/website in the caption.
The Collaborator must not alter, edit, crop, apply filters to, or otherwise modify delivered images, or remove any watermark or attribution, without the Photographer's prior written consent.
9. Cancellation & Rescheduling
As no fee is charged for a TFP shoot, no cancellation payment applies. However, the Collaborator agrees to give the Photographer at least 48 hours' notice if they need to cancel or reschedule, out of respect for the time the Photographer has set aside.
The Photographer reserves the right to decline future TFP collaboration with a Collaborator who cancels or fails to attend with less than 48 hours' notice on more than one occasion.
If the Photographer is unable to attend a confirmed shoot due to illness, emergency, or other unavoidable circumstance, the Photographer will make reasonable efforts to reschedule at the earliest mutually convenient time.
For outdoor shoots, in the event of severe weather or conditions that make the shoot unsafe or impractical, the parties will agree to reschedule at no cost to either party.
10. Conduct & Safety
Either party may pause or end the shoot early if they feel unsafe, unwell, or uncomfortable at any point, without penalty.
The shoot will proceed only on the concept, poses, and wardrobe agreed in advance. Any request to change the agreed concept on the day (including any request involving nudity, implied nudity, or content not previously discussed) may be declined by either party.
Where practical, the Collaborator is welcome to bring a friend, family member, or chaperone to the shoot.
11. Liability
The Photographer holds public liability insurance. As no fee is paid under this Agreement, and to the maximum extent permitted by law, the Photographer's total liability arising from this Agreement is limited to the cost of reshooting the session. The Photographer is not liable for indirect or consequential loss, or for loss or damage arising from circumstances beyond their reasonable control (including equipment failure, provided reasonable backup procedures were followed).
12. Dispute Resolution
This Agreement is governed by the laws of Victoria, Australia. In the event of a dispute, both parties agree to first attempt to resolve the matter in good faith through direct discussion. If the dispute cannot be resolved within a reasonable time, either party may refer the matter to mediation before pursuing formal legal action, and both parties submit to the jurisdiction of the courts of Victoria, Australia.
13. Acceptance
By confirming a shoot date and attending the shoot on a TFP basis, the Collaborator confirms they have read, understood, and agree to be bound by the terms of this Agreement, including the review and video testimonial obligations in clause 5.
